Battery (720 ILCS 5/12-3) and Aggravated Battery (720 ILCS 5/12-3.05)

A person commits Battery if he or she knowingly without legal justification by any means (1) causes bodily harm to an individual or (2) makes physical contact of an insulting or provoking nature with an individual.

Battery is a Class A misdemeanor.

However, Battery can become Aggravated Battery in certain cases of Battery, for example:

(1) Offenses based on injury that cause great bodily harm or permanent disability or disfigurement and certain other types of injury specified in the Code,
(2) Offenses based on injury to a child or person with an intellectual disability
(3) Offenses based on location of conduct, such as on or about a public way, public property, a public place of accommodation or amusement, a sports venue, or a domestic violence shelter, or in a church, synagogue, mosque, or other building, structure, or place used for religious worship
(4) Offenses based on status of victim, such as committing battery on persons 60 years of age or older, on teachers on school grounds, on a person who is pregnant, and more.
(5) Offenses based on the use of a firearm
(6) Offenses based on certain other types of conduct described in the Code.
